1. Scope of Services
Landscapers Maida Vale offers a range of landscaping services including garden design, maintenance, installation, and consultancy. Our services are tailored to meet the specific needs of each client, ensuring high-quality outcomes.
2. Pricing and Payment
All prices for services are provided in advance and are based on the scope of work agreed upon. Payment terms are as follows:
- 50% deposit required upon acceptance of the quote.
- Remaining 50% due upon completion of the project.
- Payments can be made via bank transfer, credit card, or cheque.
Late payments may incur additional charges as specified in the invoice.
3. Cancellation Policy
Clients may cancel services with a 14-day notice prior to the scheduled start date without incurring any penalties. Cancellations made within 7 days of the start date may be subject to a cancellation fee equivalent to 20% of the total service cost.
4. Changes to Services
Any amendments to the agreed-upon services must be requested in writing. If changes alter the scope of the project, additional costs may apply. Landscapers Maida Vale reserves the right to adjust pricing accordingly.
5. Client Responsibilities
Clients are responsible for ensuring that the work site is accessible and free from hazards. This includes providing necessary permissions and ensuring that all utilities are marked and accessible. Failure to do so may result in project delays or additional charges.
6. Liability
Landscapers Maida Vale strives to perform all services to the highest standards. However, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Insurance coverage is maintained to protect both parties against unforeseen circumstances.
7. Warranty
We provide a 12-month warranty on all installations, covering defects in materials and workmanship. This warranty does not cover damage caused by natural wear and tear, accidents, or improper maintenance by the client.
8. Termination
Either party may terminate the agreement with written notice if the other party breaches any material term of these conditions. Upon termination, the client agrees to pay for all services rendered up to the termination date.
9. Governing Law
These terms and conditions are governed by the laws of the United Kingdom. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in London.
10. Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information exchanged during the course of the project. This includes business practices, designs, and client information.
11. Force Majeure
Landscapers Maida Vale is not liable for any failure to perform its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, war, or governmental restrictions.
12. Intellectual Property
All designs, plans, and other intellectual property created by Landscapers Maida Vale remain the property of the company. Clients are granted a non-exclusive license to use these materials for their intended purpose.
13. Amendments
Landscapers Maida Vale reserves the right to modify these terms and conditions at any time. Clients will be notified of any significant changes, and continued use of services constitutes acceptance of the updated terms.
14. Severability
If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will continue to be in full force and effect.
15. Entire Agreement
These terms and conditions constitute the entire agreement between the client and Landscapers Maida Vale, superseding all prior agreements and understandings.
